1. General

Fonfrège is a French brand with corporate offices in San Francisco, California. In the United States, Fonfrège and all of its associated trademarks is solely licensed to Soleilleux Holdings, which also handles U.S. sales and distribution.

This Privacy Policy governs the manner in which Fonfrège (“Fonfrège” “we” “us” or “our”) collects, uses, maintains and discloses information collected from visitors (“visitor(s)”, “you”, “your” or similar terms) on our website located at http://www.fonfrège.com (the “Site”). Please read these Legal Terms carefully to understand how your information is treated.

By accessing and using the Site, you represent and warrant that you have read and understood, and that you agree to be bound by this Privacy Policy.  In addition to this Privacy Policy, we have established a Terms and Conditions of Use and Sale, a copy of which can be found here. The Terms and Conditions of Use and Sale is incorporated by reference into this Privacy Policy. You should review the Terms and Conditions of Use and Sale as it also governs the use of our Site. Your access to and use of the Site also constitutes your acknowledgement and agreement to our Terms and Conditions of Use and Sale. If you disagree with any part of this Privacy Policy, you do not have permission to access or use the Site.

 

2. Changes to Our Privacy Policy

We reserve the right to update this Privacy Policy, at our discretion. We will notify you of any updates by posting a notice on the Site or by email sent to your most recently provided email address. By continuing to access and use the Site after receiving notice of an update, you agree to be bound by the revised Privacy Policy. Our use and disclosure of particular information will be governed by the Privacy Policy in effect at the time we gather that information.

 

3. What Information Is Collected and How It Is Collected

(i)           Personal Information

Each visitor to the Site may, at his/her option, provide Fonfrège with personal information, information that can be used to personally identify or contact you (e.g., your name, email address, mailing address, telephone number, billing information [credit/debit card number, expiration date, billing address and other information needed to process payments], sex, birth date, products purchased, message and gift recipients’ names, addresses, telephone numbers and email addresses, etc.).Fonfrège uses this information in order for us to better understand visitors’ expectations, and to provide information on Fonfrège products or services to visitors who have opted for receiving such information.

If the visitor has notified Fonfrège that he/she wishes to receive any details of Fonfrège products or services, Fonfrège may contact the visitor by email, telephone or post to provide the visitor with details of Fonfrège products or services or any other information which Fonfrège believes may be of interest. The holding and using of information will be governed by the Data Protection Act 1998 and also by French law where this offers the visitor greater protection for his or her personal information.

(ii)         Non-Personal Information

Non-personal information is information that, unless combined with personal information, cannot be used to identify or contact you (e.g., IP address, domain server, referring page, click stream data, etc.). 

We may collect this information through the Site, emails, mail, fax, and telephone, and social media applications, including when you place an order, and engage in other activities, services, products and resources we make accessible to our visitors.

 (iii)       Usage Data

We collect data generated by your usage of the Site (“Usage Data”). Usage Data may or may not be associated with an individual’s identity. The servers hosting the Site, like most servers, gather this type of data that browsers routinely make available, such as your IP address, domain server, browser type, operating system, date/time, referring and exit pages, and “click stream” data relating to your navigation and use of the Site. To the extent non-personal information is combined with personal information, Fonfrège treats the combined information as personal information. Additionally, under some local laws, certain Usage Data such as IP addresses are considered personal information. To the extent such local laws apply, we treat the required Usage Data as personal information. Otherwise Usage Data is not treated as personal information.

(iv)        Payment Information

We will collect information about your payments, including your credit card number when you purchase merchandise on our Site. For more information on how and where this information is stored, please refer to Section 7 “How Your Data Is Stored.”

 (v)          Information You Submit or Post

We collect the information you post in a public space, whether on our social media pages or on our Site, for instance when you post a product review.

 (vi)        Customer Service Data

We collect and save communications (including emails) and other personal information and non-personal information received or created in the course of responding to customer service inquiries.  You can reach our customer service department at through our general contact form.

 

4. How Does Fonfrège Use the Information Collected?

 (i)           Personal Information

Fonfrège uses your personal information to facilitate your navigation of and shopping from the Site and to keep you informed of Fonfrège news and offers; to enforce our Terms and Conditions of Use and Sale; to meet any applicable law, regulation, subpoena, legal process or enforceable governmental request; to notify you about issues with or changes to the Site, our Terms and Conditions of Use and Sale or this Privacy Policy; to deliver tailored advertisements which may interest you; to email you with marketing or promotional information about Fonfrège or others’ products or services that may interest you; or for any other purpose with your consent.

Fonfrège uses third-party vendors to provide various services, including data storage and processing, fraud detection, and data analysis.  We provide those vendors with your personal information, though only as absolutely necessary for them to perform those services. We require our vendors to contractually agree to treat your information in accordance with the Privacy Policy in effect at the time we collected that information.  All the vendors to whom we provide data are located in both France and the United States .

Fonfrège may, from time to time, obtain your permission to share your personal information. For example, we may ask you if you would like one of our partners to contact you with special promotions or deals, or if you could provide us with a testimonial and are willing to be quoted. Fonfrège understands that it is important to always obtain your permission first, before sharing this type of information.

(ii)         Non-Personal Information     

Fonfrège uses your non-personal information to better understand how you and others are using the Site, and to help us detect security threats and potential fraud. By better understanding how the Services are used, we are able to refine and expand popular features, increase technical capacity in advance of bottlenecks, and generally improve the Site’s usability, stability and security. We do not attempt to match non-personal information with personal information, or to otherwise individually profile you based on your use of the Site.

Fonfrège discloses non-personal information in aggregate form to consultants hired to help us improve the Site and to accomplish the goals set out in the prior paragraph. We also disclose non-personal information in occasional reports summarizing usage of the Site.

 

5. Cookies

Cookies must be enabled in order to complete a transaction. It is the visitor’s responsibility to understand how cookies work.

(i)           What is a Cookie?

A cookie is a text file which is stored in a dedicated area of your Device’s* hard drive when you visit an online service. A cookie enables us to identify the Device on which it is stored, until such cookie reaches its expiry date.

*“Device” means any electronic equipment (computer, tablet or smartphone…) that you use to browse a website, an application, an advertising content etc.

(ii)         What Types of Cookies Do We Use?

When you connect to our Site, we may, depending on your settings, use some cookies enabling us to recognize the web browser on your Device until said cookies expire.

Third party cookies are subject to said third party privacy policies. We hereby inform you about the purpose of these cookies and how you can manage them, to the extent we are aware thereof.

We may choose to include in our Site some third-party applications that provide you with the possibility to share content with third parties or to let other persons know you browsed our Site. The “Like” and “Share” functionalities offered by social network platforms (“Facebook”, “Twitter”, etc.) are examples of this and are included on our Site.  

Social networks which offer these functionalities may identify you even though you do not use these functionalities on our Site. Indeed, such functionalities allow social network platforms to track information about your browsing on our Site whenever your social network account is in active session while browsing on our Site.

We do not control how these social network platforms collect your personal data while you are browsing our Site. We invite you to read the privacy policies of these social networks to find out how they use browsing information they collect (including for advertising purposes) through these features. These privacy policies should provide you with information about how to manage your preferences on your social network accounts.  

Our website may contain third-party cookies (delivered by advertising agencies, analytics providers, etc.) enabling them to collect browsing information on your Devices, including to measure the efficiency of our search engine advertising campaigns.

6. If You Share the Use of Your Device with Other People

If you share your Device with other people and the Device operates several browsers, we cannot guarantee that personalized services and advertisement designed to match your personal use of the Device (if such personalized services and advertisement are available) will correspond to your own use rather than someone else’s.  

The sharing of your Device and the settings of your browser regarding cookies are your own choice and under your own liability.

7. How Your Data Is Stored

Fonfrège uses Shopify to provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall. If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. 8. Transfer in the Event of Sale or Change of Control

In the event Fonfrège undergoes a merger, sale, or reorganization, the information we have collected from you, both personal and non-personal will be transferred to and used by the acquiring entity. Should a bankruptcy or reorganization proceeding be brought against us, all such information may be considered an asset of Fonfrège and as such may be sold or transferred to third parties. Any acquirer of your information would be obligated to treat that information in accordance with the version of this Privacy Policy in effect when that information was collected. Fonfrège will not be liable for the use of disclosure of information no longer in its possession.

 

9. Users in California

Residents of the State of California, under California Civil Code Section 1798.83, have the right to request information regarding the disclosure of your personal information by Fonfrège to its affiliates and/or third parties for their direct marketing purposes. You are limited to one request per calendar year.

To make such a request, please send a message through our general contact form attesting to the fact that you are a California resident and include your full name, telephone number, email address and current California mailing address for our response. Please include “California Privacy Rights” in the subject line of your message.

 

10. Applicable Users Outside the U.S.

Fonfrège may share data internally within our company and with our vendors, and your personal information may be processed on a server located in the United States. You consent to having your personal information transferred and processed in the United States.

 

11. Children

Our Site is meant for adults and Fonfrège does not knowingly collect personal information from children without permission from a parent or guardian. Fonfrège does not intentionally target or solicit anyone under thirteen (13) years of age. If Fonfrège learns or has reason to suspect one of our visitors is under the age of 13, we will delete any personal information that has been collected from that visitor.  

 

12. Protection of Your Information

Fonfrège has implemented technical and administrative security measures such as, but not limited to, firewalls, encryption techniques, and authentication procedures, among others, to maintain the security of your online session. Please be advised that while we strive to protect your personal information, we make no guarantees or assurances about our ability to prevent any such loss or misuse and we are not responsible in the event that such loss or misuse occurs. 

 

13. We Don’t Track You

Other than for purpose of analyzing non-personal information in aggregate form, we do not permit third parties to collect information about you or your or others’ use of the Site.

 

14. Third-Party Sites

Please be aware that this Privacy Policy applies only to information Fonfrège collects through use of our Site. Our Site may contain links to third party payment processors and other third-party websites that we do not own, control, or maintain. Fonfrège is not responsible for the privacy practices of such other sites. We encourage you to read the privacy policies of each and every third-party website that you visit and interact with before submitting any personal information.

 

15. Corrections, Deletions and Account Terminations

In accordance with French Law “Informatique et Libertés” n°78-17 of January 6, 1978, as modified by the law of August 06, 2004, the visitor may access his/her personal information and modify or delete it.  Each visitor may also refuse, at no cost, to be contacted by Fonfrège in which case he/she will no longer receive details on Fonfrège products or services. Your account may be deleted at any time by means of the Site.
